1. About these terms

These terms apply to the use of the AM Vocal Studio website and to enquiries, applications, bookings and services supplied by Amelia McCloskey trading as AM Vocal Studio (“AM Vocal Studio”, “we”, “us” or “our”). A person using the website, applying, booking or receiving a service is referred to as “you” or the “client”.

Service-specific information shown at checkout, in a booking confirmation, written offer or signed agreement also forms part of the contract. If an individually agreed written term clearly conflicts with these general terms, the individually agreed term will take priority for that service.

2. When a contract is formed

Submitting an enquiry or application does not by itself create a contract, reserve an appointment or require either party to proceed.

For a directly bookable service, a contract is normally formed when AM Vocal Studio accepts the booking and sends confirmation after any required payment. For a privately offered ongoing service or programme, a contract is formed only when the applicable written offer or agreement has been accepted and any stated initial payment has been made.

We may decline an enquiry, application or booking where the service is unsuitable, unavailable, outside our professional scope, or cannot be delivered safely.

3. Prices, payment and availability

• Prices, duration and inclusions are those displayed or agreed when the service is confirmed.
• Payment is due using the method and by the deadline stated during booking, in the invoice or in the written agreement.
• An appointment or programme place is not secured until all stated confirmation steps have been completed.
• Prices and service structures may change for future purchases. A confirmed price will not be changed retrospectively unless both parties agree in writing.
• Recording, production, public relations, distribution and other third-party costs are not included in Artist Development programme fees unless a written offer expressly says otherwise.

4. Vocal Strategy Session

The Vocal Strategy Session is a substantive 60-minute private service costing £125. It may include discussion of vocal history and goals, observation of the voice, practical exercises, feedback and recommended next steps.

The fee pays for the standalone session. Booking does not guarantee admission to Structured Vocal Development, Artist Development or any other future service.

5. Structured Vocal Development

Structured Vocal Development costs £295 per billing month and includes two 60-minute private sessions to be used within that billing month. Unused sessions do not roll over.

Notice may be given during the initial term, but the service will not normally end before the third billing month unless a statutory right applies or AM Vocal Studio agrees otherwise in writing.

6. Artist Development application and consultation

An Artist Development application allows AM Vocal Studio to assess whether a paid consultation may be appropriate. You confirm that the information supplied is accurate to the best of your knowledge and that you have authority to provide any music, video, personal information or other material included in the application.

If invited, the Artist Development Consultation is a 90-minute paid service costing £225. It includes reasonable preparation and advance review of the application, two original tracks and one live-performance video provided through accessible links.

The consultation may explore the artist’s current position, priorities, potential strategy, suitability and possible next steps. It does not guarantee a programme offer, commercial result, representation, management, release, funding, pitching opportunity or third-party engagement.

7. Bespoke Artist Development programmes

A bespoke Artist Development programme is a separate later service, with programmes starting from £750 per month and a minimum six-month commitment. The final scope, monthly fee, term, deliverables and any third-party costs depend on the artist’s needs and will be confirmed in a separate written offer and programme agreement.

No programme begins automatically after an application or consultation. It begins only if AM Vocal Studio and the artist both decide to proceed, the separate agreement is accepted, and any required initial payment is made.

If both parties proceed under an agreed programme offer, the £225 Artist Development Consultation payment will be credited towards the programme fee in the manner stated in that offer.

8. Appointment changes, cancellations and refunds

The Booking, Cancellation & Refund Policy forms part of these terms for appointments and paid services.

In summary, one transfer may be requested for an appointment with at least 48 hours’ notice and is subject to availability. A request made with less than 48 hours’ notice, a second change or non-attendance will normally mean the session is treated as used. Illness-related transfers remain discretionary. If AM Vocal Studio cancels, an appropriate replacement, credit or refund will be offered.

These operational rules do not remove any legal cancellation, refund or other consumer right.

9. Online cancellation rights

Where UK consumer law gives you a cooling-off right for a distance or off-premises service contract, you will normally have 14 days after the day the contract is made to cancel without giving a reason, unless a statutory exception applies.

If you expressly ask for a service to begin during that period and later cancel, you may be required to pay a proportionate amount for what has already been supplied. If the service is fully performed during that period after your express request and acknowledgement, the statutory right to cancel that completed service may be lost.

10. Client responsibilities and safe participation

You agree to provide accurate relevant information, attend on time, participate respectfully and follow reasonable studio, online-session, health and safety instructions.

You remain responsible for deciding whether to act on creative, career or business suggestions and for obtaining appropriate medical, legal, financial, tax or other specialist advice where needed. Vocal Coaching is educational and developmental; it is not medical diagnosis or treatment.

Please disclose relevant illness, pain, vocal injury or other condition that may make participation unsafe. AM Vocal Studio may pause, adapt or postpone work where continuing would be unsafe or professionally inappropriate.

11. Clients and artists under 18

A parent or legal guardian must make or approve the booking or application, accept the applicable terms, handle payments and remain responsible for required communications and consents for a client under 18.

AM Vocal Studio may set reasonable safeguarding arrangements, including requirements concerning attendance, communication channels, recording and collection from the studio. A service may be paused or declined if these arrangements cannot be followed.

12. Music, recordings and other client materials

You retain ownership of music, lyrics, recordings, videos and other original material that you own. By supplying material, you confirm that you own it or have permission to share it for the relevant application, review, consultation or service.

You grant AM Vocal Studio only the limited permission reasonably needed to access, review, store and use the material to assess the application and supply the requested service. Supplying material does not authorise its public release, distribution, pitching, licensing, sale or promotional use.

Any later recording, production, pitching, distribution, licensing, testimonial, case study or promotional use requires a separate clear agreement or permission.

13. AM Vocal Studio materials and intellectual property

Unless otherwise agreed, AM Vocal Studio retains ownership of its website content, teaching methods, exercises, written resources, programme structures, templates, session notes and other original materials.

You may use materials supplied to you for your own personal artistic and professional development. You must not reproduce, sell, publish, teach, distribute or commercially exploit them without prior written permission, except where the law permits.

14. Confidentiality and privacy

Each party should treat genuinely confidential personal, creative and commercial information received through the service with reasonable care. This does not prevent disclosure required by law, needed for safeguarding, or reasonably necessary to obtain professional advice or operate the service.

Personal information is handled as explained in the Privacy Notice. That notice also explains data protection rights, retention, service providers and international transfers.

15. Third-party services and links

The website and services may use or link to third-party platforms for scheduling, payments, video calls, file sharing, streaming or other functions. Those providers may apply their own terms and privacy notices.

AM Vocal Studio is not responsible for the independent content, availability or acts of a third-party platform outside its reasonable control. This does not affect responsibility for choosing and using service providers with appropriate care where AM Vocal Studio is legally responsible for doing so.

16. Professional scope and outcomes

Artistic progress and career outcomes depend on many factors, including the client’s participation, practice, decisions, health, material, market conditions and third parties. AM Vocal Studio will provide agreed services with reasonable care and skill but does not guarantee a particular vocal, creative, commercial or career result.

Unless a separate written agreement expressly says otherwise, AM Vocal Studio is not acting as the client’s manager, agent, record label, publisher, lawyer, accountant, doctor or therapist and has no authority to bind the client to third-party arrangements.

17. Suspension and ending a service

AM Vocal Studio may pause or end a service where there is serious or repeated non-payment, abusive or unsafe conduct, material dishonesty, infringement of another person’s rights, persistent failure to follow reasonable safeguarding requirements, or another material breach that is not remedied after reasonable notice where a remedy is possible.

Any payment, credit or refund consequence will depend on the circumstances, services already supplied, unavoidable loss, the applicable agreement and the client’s statutory rights. AM Vocal Studio will not retain more than is lawful and fair.

18. Liability and statutory rights

Nothing in these terms excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or the client’s statutory consumer rights.

Services will be provided with reasonable care and skill. Where consumer law applies, the client may have rights to repeat performance, a price reduction, cancellation, refund or other remedy if a service is not supplied as legally required.

AM Vocal Studio is not responsible for loss caused by inaccurate or incomplete information supplied by the client, failure to follow reasonable instructions, unauthorised use of materials, or events outside reasonable control, except to the extent that the law makes AM Vocal Studio responsible.

19. Website use

You may use this website for lawful personal or business enquiry purposes. You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with operation, scrape protected content or use website material in a way that infringes intellectual property or privacy rights.

We aim to keep information accurate and the website available but cannot promise uninterrupted access. We may correct errors, update content or temporarily restrict access where reasonably necessary.

20. Complaints and resolving concerns

Please email info@amvocalstudio.com with enough information to identify the service and concern. AM Vocal Studio will aim to acknowledge the complaint promptly and respond fairly within a reasonable time.

If a concern cannot be resolved directly, you may seek independent consumer advice or use any court or dispute-resolution option available to you by law.

21. Governing law

These terms and any non-contractual dispute are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, except that a consumer living elsewhere may retain any right to bring proceedings in the courts of the part of the United Kingdom or other country where they live where applicable law provides that right.

22. Changes to these terms

We may update these terms when services, business practices or legal requirements change. The date at the top will show the latest revision. Changes will apply to future website use, applications and contracts; they will not retrospectively replace an already agreed contract unless both parties agree or the law permits or requires the change.
